TERMS OF USE AND PRIVACY POLICY

The 2020 Minnesota Work Comp Forum (the “Forum”) is jointly organized and presented by the Workers’ Compensation Reinsurance Association and Minnesota Workers’ Compensation Insurers Association (hereinafter collectively referred to as the “Organizers”). The Organizers operate and make available the website www.mnworkcompforum.com as well as subdomain websites for the Forum (individually “Website” and collectively “Websites”) and make them available to the users of the Websites (individually “Visitor” and collectively “Visitors”) under the following Terms of Use and Privacy Policy.

Agreement to the Terms of Use

The Websites may contain features and information that may be available from time to time. Any person that accesses or uses the Websites agrees to be bound by the terms and conditions of these Terms of Use. These Terms of Use contain conditions, disclaimers and other provisions, some of which limit the Organizers’ liability. Any person that does not agree or comply with these Terms of Use should not access or use the Websites.  BY USING THE WEBSITES, YOU AGREE TO THESE TERMS OF USE AND PRIVACY POLICY; IF YOU DO NOT AGREE, DO NOT USE THE WEBSITES.

Appropriate Use

Any use of the Websites by Visitors that would limit or constrict the availability or quality of the Websites’ features is prohibited and the Forum reserves the sole right to take any actions required to enforce this principle.

Visitors shall not use the Websites to post, submit or otherwise distribute unlawful, defamatory, abusive, obscene or offensive materials. Furthermore, Visitors shall not use the Websites in any way that may violate third party rights including, but not limited to copyrights or privacy. Neither shall Visitors access or attempt to access the Websites using interfaces aside from the ones provided by the Websites.

Visitors may provide personal information as part of the registration to access and use some of the features on the Websites as exhibitors, sponsors, participants, or similar parties. Information provided for registration must be accurate, correct and up-to-date. The Forum reserves the sole right to verify and deny access where data is incomplete, incorrect, inappropriate and/or missing.

Disclaimer

The Websites are provided “as is” and “as available” with no express or implied warranties of any kind including, but not limited to, any implied warranties of fitness for a particular purpose, merchantability, non-infringement, and title. The Organizers disclaim any and all liability for the acts, omissions and conduct of any third parties in connection with or related to Visitors` use of the site. Visitors assume total responsibility for their use of the site and any linked sites. If this disclaimer is not enforceable under applicable law, it may be modified at the Organizers’ sole discretion to a form that is enforceable.

The Organizers do not take responsibility for the correctness, completeness, up-to-datedness or quality of the information provided on the Websites. The Organizers expressly disclaim any and all liability to any person in respect of anything done or omitted to be done wholly or partially in reliance upon the contents of the Websites.

Furthermore, the Organizers are not liable for any damage or corruption caused by viruses (or similar mechanisms such as worms, lock outs, metering, or self-destruct mechanisms) on computers or other terminal equipment in connection with visiting, using and/or downloading data of any kind from the Websites. The Visitors are personally responsible for protecting their equipment appropriately from viruses and other risks on the Internet.

Limitation of Liability

To the fullest extent permitted at law, neither the Organizers nor any of the Organizers’ respective directors, employees or other representatives will be liable for damages arising out of or in connection with the use of the Websites or the information, content, materials or products included on the Websites. VISITORS ASSUME TOTAL RESPONSIBILITY FOR THEIR USE OF THE WEBSITES AND ANY LINKED WEBSITES. THEIR SOLE REMEDY AGAINST THE ORGANIZERS FOR DISSATISFACTION WITH THE WEBSITES OR ANY CONTENT IS TO STOP USING THE WEBSITES OR ANY SUCH CONTENT. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

Website Content

The Organizers publish their own content as well as links, content and resources provided by third parties and content that has been specifically commissioned by the Organizers for publication on the Websites.

All proprietary rights relating to any third party links, content or resources published on the Websites remain with the original source or the author(s) of that material and where any content has been commissioned by the Organizers for publication on the Websites remain with the relevant author, unless otherwise agreed or specified.

For all other content published on the Websites, the Organizers reserve all proprietary rights including, but not limited to, copyrights, trademarks and other intellectual property rights in and to all content on the Websites; this includes all text, graphics, photographs, logos and/or other items that appear on the Websites. The Organizers also reserve their rights over the Websites’ template, including its layout and structure.

Visitors are not authorized to use the Organizers’ or the Forum’s name, logo or likeness without prior consent.

The content, links and resources on the Websites are provided for general information only. It is not intended to amount to advice on which Visitors should rely. Visitors must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Forum's site. Although the Organizers make reasonable efforts to update the information on the Websites, the Organizers make no representations, warranties or guarantees, whether express or implied, that the content on the Websites is accurate, complete or up to date.

Links to other websites

Links on the Websites may connect Visitors to external or third-party websites that are not related to the Forum or under the Organizers’ control. The Organizers are not responsible for the content of external or third party websites that may be accessible or displayed through external links on the Websites. The presence of these external links does not represent the Organizers’ endorsement of the views or content of these third party websites. Navigating to external websites through links on the Websites is done at the sole risk of the Visitor, and the Organizers expressly disclaim any liability for any content that appears on any external site.

Amendments and Changes to Websites

The Organizers may amend these Terms of Use at any time, and such amendments will be effective immediately upon notice being provided to the Visitor. Notice may be provided on the Websites itself, and after posting of the notice, the Visitor’s continued use of the Website will be deemed as acceptance of the modified Terms of Use.

The Organizers reserve the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Websites, or any portion of the Websites, for any reason; (2) to modify or change the site, or any portion of the Websites, and any applicable policies or terms; and (3) to interrupt the operation of the Websites, or any portion of the Websites, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Waiver and Severability of Terms of Use

The failure of the Organizers to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties` intention as reflected in the provision and the other provisions of these Terms of Use shall remain in full force and effect.

Applicable law

These Terms of Use shall be governed by and interpreted in accordance with the substantive laws of the State of Minnesota, under exclusion of any conflicts of laws principles.

Privacy Policy

This Privacy Statement discloses the privacy practices for all the Websites.

The Organizers are committed to internet privacy and would like Visitors to be well informed of the gathering and use of their information through these Websites. The following form essential parts of the Privacy Policy:

·         monitoring of general trends in the use of the Websites but no tracking of individual Visitors;

·         no collection of information concerning Visitors unless that information is voluntarily disclosed, for example by signing up as a exhibitors, sponsors, participants, or similar parties, or subscribing to updates from the Website;

·         no selling or renting of information voluntarily disclosed through the Website nor sharing of it with any third parties; and

·         individuals who submit information will only be contacted by the Organization for purposes related to the Forum or subsequent forums.

This Privacy Policy is incorporated into the Websites’ Terms of Use. Any person that uses the Websites or registers on the Websites acknowledges having read and agrees to be bound by the terms and conditions of the Terms of Use and this Privacy Policy, as they may be amended from time to time. Any Visitor that uses or accesses the Websites agrees and consents to the collection of personal information in the manner outlined in this Privacy Policy.

Data Collection

The Websites collect two categories of information:

General information: The Websites automatically collect non-personally identifiable information using the Websites’ cookies to monitor Visitor usage patterns and information. The only information the Websites collect from a normal visit is the IP address, domain name, browser and type of machine used, referring websites, downloaded files, requested pages and time and date of those requests.

Personal information: In order to access certain features or register for the Forum, Visitors may be asked to submit information such as their name, e-mail address as well as certain other identifying information. This information is only collected where provided on a voluntary basis through the completion of one of Forum`s forms by the Visitor and is kept in the Forum databases and mailing lists.

Use of Information

The Organizers will analyze browsing patterns and usage trends of the Websites’ Visitors with the general information collected.

The Organizers periodically summarize and analyze these log files to learn how Visitors use content on the Website. This information is used to allocate resources effectively and to improve the content, organization and performance of Forum Websites. This process does not collect, store or use personally-identifying information such as name, address, telephone number or email address.

Use of Cookies

A cookie is simply a small piece of information that a web server asks a Visitor’s browser to store on the Visitor’s local computer, and then later their browser presents this information to the web server. In its simplest form, a cookie is an identifying number.

The Forum Websites use cookies for anonymous Visitor tracking. The Forum web server assigns each Visitor a unique numerical ID. All requests for pages are tagged with that ID, and by analyzing log files, the Forum can determine how many unique Visitors used the Website.

The Organizers do not know the identity of a person based on the numerical ID. The cookies used on the Websites do not contain any personal information about Visitors nor are they used to look up personal information about Visitors. Even if Visitors have entered information about themselves in one of Forum`s registration forms, the Organizers do not relate that information to the cookie data.

Security

Any information provided to the Organizers by Visitors of the Websites is handled with due care and security, and will not be used in ways other than as set forth in this Privacy Policy, or in any site/area-specific policies, or in ways to which Visitors have not explicitly consented. The Organizers employ a range of technologies and security measures to protect the information maintained on Forum systems from loss, misuse, unauthorized access or disclosure, alteration, or destruction. When Visitors submit sensitive information via the Websites (such as credit card numbers or social security numbers) such information is encrypted and protected with SSL encryption.

Electronic Mail

When a Visitor sends personal identifying information via email (that is, in a message containing a question or a comment, or by filling out a form that emails the Forum this information), the Organizers use it to respond to Visitors’ requests. The Organizers may forward Visitors’ email to other employees of the Organizers (including Affiliates or branches of the Organizers) who are better able to answer Visitors’ questions. The Organizers do not retain or distribute lists of email addresses to any parties outside of the Organizers. In no event, do the Organizers distribute lists of e-mail addresses to any outside parties. Information collected via email will be retained at the Organizers’ sole discretion in a directly readable form as long as necessary to complete the Organizers’ response.

External Links

The Websites contain links to other websites that are not operated or maintained by the Organizers and are not covered by this Privacy Policy. Visitors should be aware that the links on Websites are provided only for Visitors’ convenience. The Organizers have no control over, make no promises or warranties of any kind with regards to, and have no responsibility or liability for, the content of any other websites or their privacy policies, their use of cookies, or the way they collect, save, store or use information. Visitors should review the privacy policy of each website they visit.

Agreement and Notification of Amendments

By using this Website, Visitor signifies his/her agreement with the Privacy Policy.

The Organizers reserve the right, at their sole discretion, to change, modify, add or remove portions of this Privacy Policy at any time. Visitor’s continued use of these Websites following changes to these terms means Visitor accepts those changes

Applicable Law and Venue of Jurisdiction

This Privacy Policy shall be governed by and interpreted in accordance with the substantive laws of State of Minnesota, under exclusion of any conflicts of laws principles.
